Judicial Conservative

Our state government is divided into three distinct branches, each with its own specific authority. The legislative branch creates the laws, the executive branch carries out those laws and the judicial branch interprets them. Article 2 of the Texas Constitution directs that “no person or collection of persons, being one of these three departments shall exercise any power properly attached to either of the others, except in the instances herein permitted.” I take this to mean that I cannot be in the role of the judiciary and rewrite the laws promulgated by our legislature. Our role on the court is to strictly interpret those laws in a way that most closely reflects their original and stated intent.
